The motion requesting class certification defines three separate classes:
If you are a member of one or more of the proposed classes, you may benefit if the suit is successful.
By Order dated March
30, 2004, the Honorable John P. Fullam, Senior U.S. District Judge,
dismissed the Romero II Complaint on the ground that the claims asserted
by the plaintiffs are time-barred. In dismissing the Complaint in its entirety,
the Court stated that to the extent employee agents "lost pension entitlements
when they became independent contractors or former employees, that consequence
would be an element of damages if they establish that their change in status
was a breach of contract or otherwise illegal - claims which are being asserted
in Romero I and the EEOC action." Further information about the Romero
I and EEOC lawsuits can be found at www.allstatecase.com.
