This site was created by Morgan, Lewis & Bockius LLP, Sprenger & Lang, PLLC,and AARP Foundation Litigation ("Class Counsel") to provide information on the class action law suit that was filed in federal court on December 20, 2001, against Allstate Insurance Company, The Allstate Corporation, the Agents’ Pension Plan and the Plan’s Administrative Committee.

Welcome to a website providing information about a lawsuit filed on behalf of thousands of former employee agents of Allstate Insurance Company. The plaintiffs claim that through a series of amendments to its Agents’ Pension Plan during the 1990s, Allstate illegally “cut back,” or reduced, their early retirement benefits. What's the Name of the Case?

The case is called Gene Romero, et al. v. Allstate Insurance Company, et al. It is filed in the United States District Court for the Eastern District of Pennsylvania, located in Philadelphia.

What's At Stake?

Plaintiffs contend that in 1991 Allstate improperly phased out a “beefed-up” early retirement benefit and between 1991 and 1996 improperly changed several definitions in the Agents’ Pension Plan in a manner that prevented employee agents who converted to exclusive agents from continuing to accrue years of service toward qualification for early retirement. Without these changes, many more agents would have qualified for early retirement and would have received more in early retirement benefits than Allstate made available after 1991. Plaintiffs seek to have the plan reformed and to permit any persons who would have qualified for early retirement benefits to assert claims.

Am I A Class Member?

This case was sent back to the trial court by the Court of Appeals last year with instructions that the Court address first the validity and enforceability of the releases signed by almost all of the plaintiffs. Until that issue is addressed, plaintiffs will not have an opportunity to ask the judge to approve the proposed class. Until the judge rules, nobody is a class member.

When they have the opportunity, the plaintiffs intend to ask the judge to approve a class of persons who were Allstate employee agents during the 1991-96 period who were subject to these changes.
